Why this focus on collective agreements? Does it matter if you have a good employer and are satisfied anyway? Or? We explain the reason for the nagging. (But we can reveal already here that it gives you a lot of good things.)

First it was Klarna, now it’s Tesla, Spotify and a range of other companies that the trade unions are pressing to obtain collective agreements. But isn’t this just the “business idea” of the unions? Do all companies really have to do the same? Can’t some do their own thing and come up with new, better ways of working? We pose these questions to Unionens chief negotiator Martin Wästfelt.
Why do trade unions nag so much about collective agreements?
- Partly because when you become a member of Unionen, we promise to work towards collective agreements in the interest of the members. And in all the companies I’ve come across, there are members who want them.
In what way would it be better for me? Say that I work at a company that is very generous and offers perks like fully paid parental leave and a yearly health week with the family. Why would I want a collective agreement?
- Because conditions not protected by collective agreements are a snapshot. Right now, you get all these nice benefits, but there is no guarantee you’ll have them in a week. Without a collective agreement, companies can withdraw benefits with a simple email, without first negotiating with their employees about it. One could say that as an employee at a company without a collective agreement, you are more exposed to the employer’s whim.
Martin Wästfelt emphasizes that we are all different, and that should be respected.
- The more you value flexibility over stability, the less you might value a collective agreement. The more you value security, the more important it becomes.
Right now, you get all these nice benefits, but there is no guarantee you’ll have them in a week.
He says that when you scratch the surface of, for example, the more talked about tech companies, it turns out that not all employees have such favorable contracts.
- We want everyone, even those who are not as good at negotiating themselves, to have fair conditions. With a collective agreement employees also get more influence. Without it employers can make major changes without informing the staff in advance.
But why must all companies have these agreements? Isn’t it okay to be different?
- We value and encourage companies to be innovative and to come up with new business models and tech solutions. A collective agreement is not an obstacle to that. On the contrary, it can contribute to the flexibility and adaptability of companies, because if a large proportion of companies in Sweden don’t have them, more things would need to be regulated by laws, and that in turn reduces companies’ flexibility. So, in reality, it should be in the interest of more tech companies to join the model.
Many companies are chasing talent and want to be able to outbid other companies. Could that be the reason they say no to collective agreements?
- Our agreements do not prevent that. They are a minimum level, not an upper limit.
Then why do so many companies resist collective agreements?
- Often it boils down to the fact that they infringe on the employer’s right to unilaterally decide on the operations in the short term. You can make any decision you want, without first consulting the employees (via union representatives). You might also have had some successful years and genuinely believe that the company will continue to grow. But almost all companies will encounter problems at some point, which then hit the employees without collective agreements harder.
- We shouldn’t underestimate that there are some legal advisers who recommend companies not to sign these agreements, where the recommendation is in their own interest. As a business leader you might not have time to negotiate with a thousand employees, so you let the legal adviser do it instead.

Varför tjatar fackförbund så mycket om kollektivavtal ?
- Dels är det så att när du blir medlem i Unionen så lovar vi att, där det finns intresse från medlemmarnas sida, jobba för kollektivavtal . Och på alla företag jag stött på finns det medlemmar som vill ha kollektivavtal .
På vilket sätt skulle det bli bättre för mig? Om jag jobbar på ett bjussigt bolag, som erbjuder förmåner som hundra procent betald föräldraledighet och en hälsovecka med familjen per år, varför skulle jag vilja ha kollektivavtal ?
- För att villkor som inte skyddas av kollektivavtal är en ögonblicksbild. Just nu får du alla dessa fina förmåner, men det är ingen garanti för att du har dem om en vecka. Utan kollektivavtal kan företagen dra tillbaka förmåner med ett enkelt mejl, utan att först förhandla med sina anställda om saken. Man kan säga att som anställd på ett bolag utan kollektivavtal är du mer utsatt för arbetsgivarens dagsform och humör.
Martin Wästfelt understryker att vi är alla olika, och det ska man ha respekt för.
- Ju mindre du värderar trygghet och stabilitet, desto mindre kanske du värdesätter ett kollektivavtal . Ju mer du värdesätter trygghet, desto viktigare blir kollektivavtalet.

Han säger att när man skrapar på ytan hos exempelvis de mer omtalade techbolagen, så visar det sig att alla anställda inte sitter med så förmånliga kontrakt.
- Vi vill att alla, även de som inte själva är bra på att förhandla, ska ha schyssta villkor. Med kollektivavtal får anställda också ett större inflytande. Utan avtalet kan arbetsgivare genomföra stora förändringar utan att informera personalen i förväg.
Men varför måste alla företag ha kollektivavtal , kan man inte få vara och göra olika även i Sverige?
- Att företag är innovativa och vill hitta på nya bra grejer, som nya affärsmodeller och tekniska lösningar, är jättebra och något vi uppmuntrar. Kollektivavtalen är inget hinder för det. Tvärtom kan kollektivavtal bidra till företagens flexibilitet och anpassningsförmåga, för om inte en stor andel företag i Sverige har kollektivavtal skulle fler saker behöva regleras i lagar, och det om något minskar företagens flexibilitet. Så egentligen borde det ligga i fler techbolags intresse att ansluta sig till modellen.
Många bolag jagar kompetens och vill kunna bjuda över andra bolag. Kan det vara anledningen till att de säger nej till kollektivavtal .
- Nej, eftersom våra avtal inte förhindrar det. De är en miniminivå, ingen övre gräns.
Varför stretar då så många av exempelvis techbolagen emot kollektivavtal ?
- Ofta kokar det ner till att avtalet kortsiktigt inkräktar på arbetsgivarens rätt att ensidigt bestämma över verksamheten. Man kan fatta vilka beslut som helst, utan att först tillfråga de anställda (via fackrepresentanter). Man kanske också har haft några framgångsrika år och tror genuint att allt alltid ska gå uppåt, att företaget ska växa och bli mer framgångsrikt, men nästan alla företag kommer i olika skeden att få några problem, vilket då slår hårdare mot anställda utan kollektivavtal .
- Vi ska heller inte underskatta att det finns en del juridiska rådgivare som rekommenderar företag att inte skaffa kollektivavtal , det ligger i deras eget intresse. Som företagsledare kanske du inte har tid att förhandla med 1000 anställda, så du låter rättsliga rådgivare göra det istället.
